Parties and Scope
These Terms are between Kurtsan Porya Sanayi (“Kurtsan”, “Company”) and the authorised reseller, distributor, or business purchaser (“User”). The platform is a B2B (business-to-business) sales and information platform available exclusively to entities engaged in commercial activity; it is not intended for individual consumers.
Membership and Account
- Membership applications are reviewed by Kurtsan and, if approved, the account becomes active. Kurtsan reserves the right to decline any application without providing reasons.
- The User is responsible for maintaining the confidentiality of account credentials and preventing unauthorised access.
- All liability arising from use of the account by third parties rests with the User.
- Kurtsan reserves the right to suspend or terminate accounts in the event of breach of platform rules, provision of false information, or security violations.
Product Information and Prices
- Product descriptions, specifications, and prices on the platform are for informational purposes only and are subject to change without notice.
- Prices are exclusive of VAT; applicable tax rates will be reflected in the order.
- Product images are representative; actual products may differ in colour, packaging, or design.
- OEM codes and trademarks are provided solely for comparison and compatibility reference. Kurtsan makes no claim of ownership over such marks.
- Stock levels are not updated in real time; alternative products or delivery timelines will be communicated for out-of-stock items.
Orders and Contract Formation
- An order placed by the User becomes binding only upon written confirmation (by email or platform notification) from Kurtsan.
- Kurtsan reserves the right to partially or fully cancel an order for legitimate reasons (stock unavailability, pricing error, shipping restriction); any amount collected will be refunded.
- Minimum order quantities and conditions will be communicated separately.
Delivery
- Delivery timescales are estimates. Force majeure events relieve Kurtsan of liability for delays.
- Shipping costs and carrier selection are specified in the order confirmation.
- A carrier damage report must be raised at the time of delivery for any visible damage or shortage; Kurtsan assumes liability only after such documentation is provided.
Payment
- Payment terms (prepayment, deferred, wire transfer) are determined by account type and agreement.
- Statutory interest may be applied to overdue payments.
- Invoices are issued upon order confirmation or despatch date.
Returns and Warranty
- Returns are accepted within 30 days of delivery for unused products in original packaging.
- Return requests must be submitted in writing and approved by Kurtsan before goods are returned.
- Products are covered by Kurtsan's warranty terms and manufacturer specifications. Damage arising from incorrect installation, misuse, or normal wear is excluded.
Intellectual Property
All content on the platform (text, images, logos, software code, database structure) belongs to Kurtsan and is protected under applicable copyright and intellectual property law. Copying, reproduction, distribution, or creation of derivative works without prior written consent is prohibited.
Limitation of Liability
- Kurtsan does not warrant uninterrupted, error-free, or secure operation of the platform.
- Kurtsan shall not be liable for indirect, special, or consequential damages arising from temporary platform unavailability, data loss, or technical failures.
- Kurtsan's total liability in respect of any single event shall not exceed the invoice value of the relevant order.
Privacy and Personal Data
The processing of personal data is governed by our Privacy Notice and Cookie Policy, which are accessible within the platform.
Force Majeure
Kurtsan is relieved of liability for failure to perform obligations caused by events beyond its reasonable control, including natural disasters, war, terrorism, pandemic, government action, power outages, or internet infrastructure failures.
Changes
Kurtsan reserves the right to update these terms with or without prior notice. Changes take effect from the date of publication on the platform.
Governing Law and Jurisdiction
These terms are governed by Turkish Law. Konya Courts and Enforcement Offices shall have exclusive jurisdiction over any disputes arising from or in connection with these terms.
